DECISION OF THE BOARD; October 19, 2000
This is an employer application filed pursuant to Section 68 of the Employment Standards Act (the “Act”) requesting review of an Order to Pay issued by letter dated July 17, 2000 in the amount of $90,105.17.
By letter dated October 17, 2000 the Financial Administration Officer of the Ministry of Labour advised the Board that the applicant’s cheque has been “returned by the bank as not clearing the employer’s account”.
Section 68(7) of the Act requires an employer to pay to the Director of Employment Standards in trust the requisite amount in order to file an appeal under section 68. The Ministry requests this appeal be denied in light of the failure to make payment as required under the legislation.
DISPOSITION
- In the circumstances this application for review is dismissed for failure to make the required payment to the Director of Employment Standards in trust.
