DECISION OF THE BOARD; November 1, 2000
The Board, differently constituted, by decision dated July 27, 2000 in these three files directed the applicant to provide proof of delivery of the application to the responding parties and to provide the Board with accurate information that would enable the Board to deliver the necessary confirmations of filings and hearing notices.
Counsel for the applicant, by letter dated October 27, 2000 seeks to add R. L. P. Machine & Steel Fabrication Inc. as a responding party. Counsel advises that R.L.P. Mechanical Ltd. and 739183 Ontario Inc. c.o.b. G.M. Contracting had carried on business at 259 Preston Lane in Timmins. That was their last known corporate address. Counsel further advises that R.L.P. Mechanical Ltd. had its corporate status cancelled and that 739183 Ontario Inc. c.o.b. G.M. Contracting had been dissolved. Counsel submits that R. L. P. Machine & Steel Fabrication Inc. now occupies those same premises at 259 Preston Lane that had been used by R.L.P. Mechanical Ltd. and 739183 Ontario Inc. c.o.b. G.M. Contracting.
Under these circumstances, the Board is satisfied that sending documents to all of the responding parties at 259 Preston Lane in Timmins is sufficient to establish delivery of those documents.
Having regard to the request of the applicant, R. L. P. Machine & Steel Fabrication Inc. is hereby added as a responding party.
This panel of the Board is not seized with this matter.
