DECISION OF THE BOARD
- The Board, by decision issued earlier today dismissed a request by Tanya Ruth Ann Genest c.o.b. Westboro Construction (“Westboro”) for an adjournment of the hearing scheduled in this matter for tomorrow and Friday. The Board, at paragraph 5 of that decision stated: “In the absence of the applicant’s consent, Westboro’s request for an extension of time and an adjournment…is dismissed.” Counsel for the applicant, by letter transmitted to the Board yesterday evening advised that he had spoken with counsel for Westboro and had agreed to the adjournment on two conditions:
a) that Randall Wilcox Sr. accept service of subpoena that evening as had been arranged between with the applicant’s process server; and
b) that this matter be set down for hearing on October 6, 2000.
The Board was advised by the Registrar that October 6, 2000 is available for the hearing of this matter. The Board has no information before it as to whether service of a subpoena was effected upon Mr. Wilcox. Nevertheless, as the Board does have October 6, 2000 available, it seems to us that the parties have effectively agreed to an adjournment of the hearing that had been scheduled for September 14 and 15, 2000.
The Board hereby adjourns the September 14 and 15, 2000 hearing of this matter and sets this matter down for hearing on Friday, October 6, 2000 at the Board’s hearing room, 505 University Ave., second floor, Toronto, commencing at 9:30 a.m. local time.
This panel of the Board is not seized with this matter.
