DECISION OF THE BOARD; October 18, 2000
1. Board File No. 0058-99-R is a related employer/sale of a business application pursuant to section 69/1(4) of the Labour Relations Act, 1995 (the “Act”). Board File No.
0062-99-G is a grievance filed under section 133 of the Act. These applications were filed prior to August 1, 1999, the date on which the new Rules of Procedure became effective.
2. By letter dated September 5, 2000 the applicant asks to amend the application to add the following responding parties: Dominion/Circon Construction Limited and Circon Construction Limited. The title of these proceedings is amended accordingly. The Registrar is directed to send out amended notices in both Board Files.
3. The applicant further requests production of documents under section 1(5) and 69(13). Some of the responding parties object to what they view as “extremely broad pre-hearing production” in a very short time. The responding parties have indicated they would like to resolve the production issue without an order from the Board.
4. Having reviewed the correspondence from counsels representing various responding parties, dated September 12 and 19, 2000 and the materials filed to date, the Board directs as follows:
(i) the responding parties are to make available to the applicant documents that are relevant to the section 69/1(4) applications pursuant to sections 1(5) and 69 of the Act;
(ii) the responding parties are directed to meet with the Labour Relations Officer, Fred Heerema, to assist the parties with respect to any remaining production issues.
5. These matters are referred to the Registrar and the Manager of Field Services.
