Decision of the Board: September 21, 2000
1This is an application under section 96 of the Labour Relations Act, in which the Board has already held many days of hearing and received many volumes of documentary material. Moreover, a number of additional hearing days have been scheduled to receive the parties’ evidence and representations.
2However, at the last scheduled hearing day, the respondents made various motions, urging the panel to review the pleadings and the evidence received to date, then make a series of rulings limiting, or eliminating altogether, the evidence from further witnesses that the union proposes to call. In response, the union urges the Board to reject the employer’s motion, and set as many hearing days (including additional days) as may be necessary to receive evidence which, the union claims, is at least arguably relevant to the legal position that the union advances in this case.
3It is evident that the resolution of this motion will materially affect the way in which this case unfolds, and that the motion should therefore be addressed and determined prior to requiring either party to proceed with its case.
4The hearing days currently scheduled for September 26 and September 27, 2000 are therefore adjourned while the panel gives further consideration to the submissions now before it.
5Following release of the Board’s decision, the Board will cancel such dates or set such further dates as appear to be necessary in the circumstances that then obtain; however, as before, if the Board sets further hearing days, it will be done in consultation with counsel.
