Ontario Labour Relations Board
Between:
Drywall Acoustic Lathing and Insulation Local 675, United Brotherhood of Carpenters and Joiners of America, Applicant v. Metal Tech Systems Inc., Responding Party v. Universal Workers Union, Labourers’ International Union of North America, Local 183, Intervenor.
Before: Mary Ellen Cummings, Alternate Chair.
Decision of the Board; May 29, 2000
Decision
1By decision dated May 16, 2000, I directed Local 183 to deliver and file a “timely request for reconsideration of the Board’s April 28, 2000 decision.”
2By letter dated May 24, 2000, counsel for Local 183 has asked the Board to clarify “timely”, having regard to the fact that it did not receive notice of the April 28, 2000 decision until May 8, 2000.
3I thought that this had been clarified at the hearing, but perhaps my written decision created doubt.
4At the hearing, it was agreed that the time for making the request runs from May 8, at the earliest, or May 11 the date I directed Local 183 to make the reconsideration request, at the latest. Counsel for Local 183 indicated that it could make a timely request, using either May 8 or May 11 as the start of the countdown, so that it was unnecessary for me to decide which.
