DECISION OF THE BOARD; October 18, 2000

1This is an employer appeal of an Order to Pay issued by an Employment Standards Officer.

2Following the commencement of the hearing, the parties agreed to settle this matter on the following terms:

(a) The employer will pay to Mr. McMahon the sum of $2,000.00.

(b) The remainder of the monies currently held in trust with the Director of Employment Standards, excluding the administration fee, will be returned to the employer.

3At the hearing, I orally made an order confirming the settlement.

DISPOSITION

4Having regard to the parties’ settlement, I hereby confirm my oral decision and hereby order:

(1) that the wages paid to the “Director in Trust” in relation to this matter be disbursed as follows:

to be paid to the Employer $ 663.17

to be paid to the Employee 2,000.00

(ii) that the administration fee as set out in the

Order to Pay be retained by the Government

of Ontario Consolidated Revenue Fund 532.63
