DECISION OF THE BOARD; October 23, 2000
1The Board issued a decision in this matter on July 4, 2000. The claimant, Lois Louisy, was awarded a gross sum of $758.00 payable from trust, and the Board considered that the amount already deducted by the employer for statutory deductions may need to be adjusted. Therefore, the decision required the applicant to provide to the Employment Standards Branch of the Ministry of Labour information about the statutory deductions.
2On August 14, 2000, counsel for the Ministry wrote to the Board advising that the applicant refuses to provide the information as directed by the Board. The Ministry proposes that, rather than reconvene the hearing, the Board should order payment of the following amounts from trust:
To the employee - $758.00
To the Ministry (Consolidated
Revenue Fund) - $131.80
To the Employer - $234.48
3This proposal was copied in writing to the other parties and the Board has not received any reply from them.
4In the absence of helpful information from the applicant, the Board must proceed on the basis of the information before it. There has been no request from any party to reconvene the hearing. The gross amount payable to the claimant has been established ($758.00). The applicant has already made $325.53 in deductions from the amount originally paid into trust, purportedly as statutory deductions to be remitted to the appropriate authorities in respect of Ms. Louisy.
5In all the circumstances, the Board amends the decision of July 4, 2000 as follows:
The Director of Employment Standards is directed
to disburse the money held in trust as follows:
To Lois Louisy $758.00
To Card Tel. Corp.
(on behalf of both applicants) $234.48
To the Government of Ontario
Consolidated Revenue Fund $131.80
Interest accrued on the above amounts
while held in trust shall be paid to the
recipients pro rata.
