DECISION OF THE BOARD; December 7, 2000
Counsel for the parties met with me on December 6, 2000. The following dates for hearing were set and a protocol for written statements was agreed upon:
These matters will be heard on the following dates: January 16, 17, 22, 29, 30, February 13, 14, 15, 16, 2001. Although they will not be scheduled as hearing dates at the present time, the parties should be prepared to continue the hearings on February 23, 26, and 27, if necessary. These dates are peremptory on all parties.
The BACU will deliver to the other parties and file with the Board on December 15, 2000 a statement of the facts on which it relies with respect to the “pension issue” raised on December 6, 2000. The statement will include a list of documents relied on, but not the documents themselves.
The IUBAC, and any other party (I do not anticipate any other party will) will deliver to the other parties and file with the Board on or before December 29, 2000 a statement of the facts upon which it relies with respect to the pension issue. The statement will include a list of any additional documents on which the IUBAC or other party relies, but no copy of the documents.
If any party objects to the introduction of any document, it shall do so on December 29, 2000 (for all other parties) or January 5, 2001 (for the BACU). The BACU will be responsible for the preparation of a single document book (without any contested document) for the purposes of the hearing. The printing costs will be divided between the BACU and the IUBAC.
The BACU is requested to provide the Board with a copy of its revised request for relief in Board File No. 2532-98-U.
