DECISION OF THE BOARD; May 4, 2000
1This is an application for certification which the intervenor claims is untimely. It asserts that it is party to a collective agreement with the responding party, a conclusion which the applicant disputes.
2In a decision dated April 10, 2000 (a different panel of) the Board directed that the matter be set down for hearing as soon as possible to determine the timeliness of the application prior to directing any representation vote.
3The matter came before the instant panel for hearing on May 2, 2000. While the applicant and intervenor were both represented, no one appeared on behalf of the responding party.
4After hearing the parties’ opening submissions, the Board suggested an expedited manner of proceeding. The parties in attendance, however, preferred to defer the hearing in order, at least in part, to insure the attendance of some employer representative(s). (The employer, on the eve of the scheduled hearing, advised the parties and the Board that it would not be attending the hearing.)
5Accordingly, the parties in attendance at the hearing agreed that the matter should be adjourned and rescheduled to a date not earlier than July 11, 2000.
6Having regard to the agreement of those parties, the matter will now continue on August 3 and 4, 2000, commencing at 9:30 a.m. at the Board’s Offices, 505 University Avenue, 2nd Floor, Toronto, Ontario.
