DECISION OF THE BOARD; October 4, 2000
On September 7, 2000, Armbro Construction Ltd. (“Armbro”) filed an application pursuant to section 61(7) of the Occupational Health and Safety Act, R.S.O. 1990, c.0.1 (the “Act”) seeking the suspension of Order No. 415113 issued by Inspector Dave Cochrane on August 27, 2000. The suspension request has been assigned Board File No. 1709-00-HS. Armbro has also filed an appeal of Order No. 415113 which has been assigned Board File No. 1710-00-HS.
The Board is in receipt of correspondence dated October 3, 2000 from counsel for Armbro. Counsel advises the Board that he has recently been retained and requests leave of the Board for a reasonable period of time to provide additional submissions regarding the suspension request.
Pursuant to its authority under Rule 9 of Appendix “C” to the Board’s Rules of Procedure, the Board is satisfied that it should permit counsel for Armbro a reasonable period of time to file additional submissions with respect to its application to suspend Order No. 415113 pending the disposition of its appeal.
The Board hereby directs Armbro to file any additional submissions with the Board and with the other parties in these proceedings by no later than October 10, 2000. Should any other party in these proceedings wish to file a supplementary reply, they are directed to do so by no later October 17, 2000.
