DECISION OF THE BOARD; July 17, 2000
1By letter dated July 14, 2000 the applicant requests pre-hearing production of a number of documents. It has attempted to serve the President of the responding party with a summons duces tecum but as of July 11, 2000 had been unsuccessful. This matter was originally scheduled for hearing for July 13, 2000. That date was adjourned by the Board in light of the fact that counsel for the responding party was away until July 20, 2000 and had departed prior to learning of the scheduled hearing date. A new date has been set for July 28, 2000.
2The request for a production order is premature. This is the referral of a grievance in the construction industry. The responding party has filed a Notice of Intent to Defend. Counsel for the responding party is expected to return July 20, 2000. Counsel for both parties are hereby directed to deal with issues of production directly prior to any request for an order from the Board. The applicant may subsequently renew its request if necessary.
