DECISION OF THE BOARD; October 2, 2000

Decision

[1]. This is a request for reconsideration of the Board’s decision dated August 31, 2000.

[2]. In its decision dated August 31, 2000, Board File No. 0889-00-ES was withdrawn with leave of the Board. The Board then directed the Ministry of Labour to disburse the funds it holds in trust in the manner set out in Order to Pay No. 47687.

[3]. It has come to the attention of the Board that the funds held in trust by the Director are also with respect to Order to Pay No. D04724, which is the subject matter of Board File No.

0888-00-ES. This matter is still before the Board.

[4]. Accordingly, the Board hereby reconsiders its decision dated August 31, 2000 to the effect that the funds held in trust by the Director are not to be disbursed at this time and are to remain held in trust pending the disposition of Board File No. 0888-00-ES.

[5]. Counsel for Darshan Singh (the “applicant”) also requests that the Board further extend the time for filing the appeal to August 15, 2000. Counsel advises that documents relating to these proceedings were not made available to the applicant until August 10, 2000. The documents were subsequently delivered to the Board on August 11, 2000.

[6]. The Board declines to further extend the filing date of the appeal as requested by the applicant. There is nothing prohibiting the applicant from filing with the Board relevant documents which come into its possession after the filing of the appeal.
