Ontario Labour Relations Board
0221-00-ES Kevin Wilson, Applicant v. Pizza Hut: Tricon Global Restaurants and Ministry of Labour, Responding Parties.
Employment Practices Branch File No. 50009189
BEFORE: Laura Trachuk, Vice-Chair.
DECISION OF THE BOARD; December 19, 2000
1The Board has received correspondence from the applicant in response to its direction of November 15, 2000. The applicant explains that he was unable to attend the hearing scheduled for November 15 as the car he had borrowed broke down. Although directed by the Board to provide any documentary evidence he had to support his explanation he did not include any. The responding party employer has not made any submissions in response but has asked again that any supporting documents be produced. The Board hereby directs the applicant to produce any documents he has that support the explanation he provided on or before January 8, 2001. If the responding party then wishes to make submissions it may do so on or before January 22, 2001.
2In the meantime this matter will be referred to the Registrar to schedule another hearing day. In the circumstances, and given that the responding party had attended on November 15 with a number of witnesses, the Board directs that the hearing be scheduled after consultation with the parties.
