William Sutinen Construction v. Ministry of Labour
File No.: 3472-99-ES Employment Practices Branch File No.: 10003837
Before: Anthony Brown, Vice-Chair.
Decision of the Board: December 8, 2000
On January 11, 2000, the applicant was ordered by an Employment Standards Officer to pay the sum of $3,541.98 plus administration fees of $354.20 (Order to Pay No. 52814). The applicant applied to the Board for an extension of time to file an application for review, but, by decision dated March 15, 2000, the Board (differently constituted) declined to extend the time for filing because no money had been paid to the Director of Employment Standards in trust. On August 29, 2000 the Board received a letter dated August 24, 2000, from the applicant repeating his request to be permitted to file an application beyond the normal time period. Attached to the letter is a photocopy of a cheque in the amount of $892.62 payable to the Director of Employment Standards.
It is clear that, even as of August 24, 2000, the applicant has not paid the required amount of money into trust. The Board therefore cannot consider his request for an extension.
The application is hereby terminated.
