DECISION OF THE BOARD; August 21, 2000
1Board File No. 0397-99-R is an application for certification.
2Board File No. 0671-99-R is an application pursuant to section 1(4) of the Labour Relations Act, 1995 (the "Act"). The parties have entered into Minutes of Settlement dated August 14, 2000 and this decision reflects the agreements made therein.
3Having regard to the agreement of the parties, the Board finds that:
all employees of Meadowcroft Group Limited and 5M Management Services Inc. employed at the retirement complex at 164 Fergus Avenue, Kitchener, Ontario, save and except Supervisors, persons above the rank of Supervisor, Administrator, Director of Care, Activities Director, and office and clerical staff,
constitute a unit of employees of the responding party appropriate for collective bargaining.
4On the taking of the representation vote directed by the Board, more than fifty per cent of the ballots cast by employees in the bargaining unit were cast in favour of the applicant.
5A certificate will issue to the applicant.
6The Registrar will destroy the ballots cast in the representation vote taken in this matter following the expiration of 30 days from the date of this decision unless a statement requesting that the ballots should not be destroyed is received by the Board from one of the parties before the expiration of such 30 day period.
7Having regard to the agreement of the parties, the Board finds that Meadowcroft Group Limited and 5M Management Services Inc. are related employers for the purposes of the Act in relation to the facility at 164 Fergus Avenue, Kitchener, Ontario.
8The responding parties Meadowcroft Group Limited and 5M Management Services Inc. are directed to post copies of this decision immediately,
adjacent to all copies of the "Notice of Vote and of Hearing" posted previously. These copies must remain posted until 30 days from the date of this decision.
9Board File No. 0671-99-R is dismissed against all the responding parties other than Meadowcroft Group Limited and 5M Management Services Inc.
