Marcello Paredes v. Carravetta Fruit Market and Ministry of Labour
File No.: 3845-99-ES Employment Practices Branch File No.: 43 002043
Before: Mary Ellen Cummings, Alternate Chair.
Decision of the Board: August 29, 2000
1This is an application for reconsideration of my April 25, 2000 decision.
2I dismissed the application because it was untimely. I denied a request to extend the time for making an application because I concluded that the applicant had not been truthful in his explanation for the delay.
3The applicant’s initial request for reconsideration was received by the Board on June 19, 2000, but because it had not been properly delivered to the other parties, it was returned to the applicant unprocessed, with directions about what he needed to do to comply with the Board’s Rules of Procedure.
4Even if I were to accept the original June 19, 2000 document as a properly filed request for reconsideration, it arrived outside the time limits in the Board’s Rules of Procedure.
5Rule 96 provides:
- No request for reconsideration will be considered where it is filed more than twenty (20) days after the date of the Board's decision, except with the permission of the Board.
6Even I were inclined to relieve against the time limits, the applicant has provided no reasons why I should reconsider my earlier decision. The applicant disagrees with my factual findings, and urges that this case is important to him.
7With respect, those are not reasons why I should reconsider my decision.
DISPOSITION
8The request for reconsideration is dismissed.
