Ontario Labour Relations Board
2148-00-U Ontario Provincial Conference of the International Union of Bricklayers and Allied Craftworkers, Jerry Coelho, Tom Oldham, Kerry Wilson, John Haggis, Luigi Scodellaro, and Robert Wilson, Applicants v. International Union of Bricklayers and Allied Craftworkers, John T. Flynn and Joe Bognar, Responding Party.
BEFORE: David A. McKee, Vice-Chair.
DECISION OF THE BOARD; November 30, 2000
1The Board is in receipt of correspondence from counsel for a proposed intervenor, the Brick and Allied Craft Union of Canada, and several of its locals. The Board notes that this correspondence was delivered to some, but not all other counsel involved in this application. Counsel requests that the consultation set for December 12, 2000 be adjourned to another date as she is not available on that date.
2December 12, 2000 is the first date set in this matter. That is, there is no question of continuity of counsel. The original date, December 13, was set by the Board without consultation with any party. There are a large number of parties and proposed intervenors, each represented by its or their own counsel. This is, unfortunately, a case where the need for expedition outweighs the desire to be accommodating to all counsel.
3The consultation will proceed on December 12, 2000, and will not be further adjourned without leave of the Board. All other dates set in the decision of November 27, 2000 for the filing of submissions remain in effect. I am seized of this matter.
