DECISION OF THE BOARD; December 21, 2000
This is an employer appeal of a decision of an Employment Standards Officer for review of an Order to Pay in respect of termination pay.
On the date and time scheduled for hearing, being December 19, 2000 neither the applicant nor the responding employee were in attendance. The Board is in receipt of a letter dated December 15, 2000 from the applicant indicating that it would not be attending the hearing. The letter also indicated that the applicant would pay the Order or settle the matter.
As the applicant did not attend, the representative for the Ministry of Labour requested that the matter be dismissed.
This application is hereby dismissed and the Order to Pay No. 58343 is confirmed.
I order the payment in trust to be paid out to the responding employee with the administration fee to be retained in the normal course.
