DECISION OF THE BOARD (J. A. RONSON DISSENTING): July 13, 2000
This is an application for certification made pursuant to the Labour Relations Act, 1995 (the “Act”) on February 18, 2000.
The Board is of the view that it should issue a “bottom line” decision at this time in order that the parties and affected employees may be apprised of the outcome of the application.
Therefore, for reasons to follow in due course, the majority finds that this application is dismissed under paragraph 8.1(5)[7] of the Act. There is no bar against a further application for certification by the applicant in respect of these employees.
The responding party is directed to post copies of this decision where they are likely to come to the attention of the affected employees. These copies must remain posted for thirty days.
