Decision of the Board
1This is an application for declaratory and other relief under sections 69 and 1(4) of the Labour Relations Act, 1995, S.O. 1995, c. 1 as amended (the "Act"). Counsel for the applicant, by letter to the Registrar dated November 10, 2000 requested that Zero Fibre Inc. be added as a responding party to this application.
2Counsel for the applicant has indicated that there are common directors between Zero Fibre Inc. and one of the other responding parties. Counsel for the applicant has advised that he has sent a copy of the application material and the notice of the Labour Relations Officer meeting to two directors of Zero Fibre Inc. (Thomas Dewar and James Dewar). The Dewars are alleged to be directors of another responding party also. Whether the applicant will be ultimately successful in its application in relation to Zero Fibre Inc. will be determined later.
3Having regard to the request of the applicant the Board hereby adds Zero Fibre Inc. as a responding party and declares that delivery of the material to the Dewars is sufficient to establish delivery to Zero Fibre Inc.
4The Board hereby extends the time for Zero Fibre Inc. to file its response to this application with the Board and deliver its response to the applicant to ten days from the date the application was delivered to it, that is, November 27, 2000.
