DECISION OF THE BOARD; April 27, 2000
This is an appeal by a Co-chair of a Workplace Health and Safety Committee from an Inspector’s decision not to issue orders. The Inspector’s decision is dated March 10, 2000.
The appeal letter is dated April 14, 2000, and was received by the Board on April 18, 2000. However, section 61(1) of the Occupational Health and Safety Act requires that appeals be made “within 30 days after the making of the order”. Therefore, this appeal is untimely. The Act gives no discretion to relieve against time limits.
I note that the applicant indicates that he was not provided a copy of the Inspector’s decision until March 28, 2000. This is curious because the applicant’s name and signature appear on the Premise/Project Form dated March 10, 2000, where he is indicated as a recipient.
In any event, I have no discretion to relieve against the statutory time limits.
DISPOSITION
- This application is dismissed.
