This is an application pursuant to section 96 of the Labour Relations Act, 1995 (the “Act”). The applicants allege that the responding party has breached its duty of representation, set out in section 74 of the Act.
The responding party submits that the applicants have failed to make out a prima facie or arguable breach of the Act.
I have reviewed the application and conclude that the applicants have pleaded a prima facie case.
