DECISION OF THE BOARD; November 1, 2000
1This is an application under section 96 of the Labour Relations Act, 1995 alleging that the responding party has violated section 74. In its response, the responding party asks that the application be dismissed without a consultation as it does not have responsibility for the applicant’s worker’s compensation claim. It appears that it is the national union, Canadian Union of Public Employees, and not the local named as the responding party which has undertaken to assist the applicant with his claim.
2The Board hereby directs the applicant to file any submissions he wishes to make with respect to the request that the application be dismissed without a hearing on or before Wednesday November 15, 2000. The Board will decide after reviewing the submissions, if any, whether to dismiss the application or to schedule it for a consultation.
