Decision
1This is an application for certification.
2A vote was ordered pursuant to a decision dated October 10, 2000.
3The responding party had given timely notice under section 8.1 that it disagreed with the union’s estimate of the number of individuals in the bargaining unit included in the application for certification.
4Prior to the vote being conducted the applicant notified the Board that it “agrees with the respondent’s assertion that the applicant does not have the requisite party (40%) percent support”.
5Having considered the material filed and the request of the applicant the Board finds that the percentage of individuals in the bargaining unit who appear to be members of the union at the time the application was filed was less than 40 percent. The Board therefore dismisses this application pursuant to section 8.1(5) paragraph 7 of the Labour Relations Act, 1995 (the “Act”). The vote therefore scheduled for October 12, 2000 is cancelled.
