DECISION OF THE BOARD; September 15, 2000
1These are two related matters; Board File No. 1652-00-R is an application for declaratory relief under sections 69 and 1(4) of the Labour Relations Act, 1995, S.O. 1995, c. 1 (the “Act”) that would result in the responding parties being bound to the provincial agreement by which the applicant is bound and Board File No. 1653-00-G is a referral of a grievance to the Board for determination under section 133 of the Act.
2Counsel for the applicant filed both applications on September 5, 2000. By letter to the Board dated September 7, 2000, counsel stated: “…the applicant waives the time limits imposed by section 133 of the Act and requests that the matters be heard together.”
3Having regard to the request of the applicant these two matters should be listed for hearing together. In these circumstances, the Board hereby extends the time under Rule 158 for the responding parties to file a Request for Hearing and Notice of Intent to Defend/Participate (Form A-87) in Board File No. 1653-00-G to the date on which the responding parties are required to file their responses to the application in Board File No. 1652-00-R, that is, Monday, September 18, 2000.
