1The Board, by decision in this matter dated March 10, 1999, adjourned this matter sine die on the basis that it would be deemed terminated unless a party requested the Board proceed with this matter within thirty days of the date of the final disposition (including judicial review and any appeals therefrom) of the matter in Board File No. 4244-96-G.
2Counsel for the applicant, by letter dated February 3, 2000, advised the Board that the Board’s decision in Board File No. 4244-96-G was quashed by the Divisional Court. Counsel also indicated that he did not know whether leave to appeal the decision of the Divisional Court will be sought or whether the matter will be remitted back to the Board. In any event, counsel requests that this matter remain adjourned sine die pending the final result of the matter in Board File No. 4244-96-G.
3It appears to the Board, based on the representation of counsel for the applicant, that the matter in Board File No. 4244-96-G has not been finally determined. The Board’s decision in this matter of March 10, 1999 continues to apply. Thus, this matter remains adjourned sine die and will be deemed terminated thirty days after the date of the final disposition (including judicial review, any appeals therefrom, and the Board’s decision following its remittal to the Board) of the matter in Board File No. 4244-96-G unless a party requests that the Board proceed with this matter within that thirty day period.
