DECISION OF THE BOARD; October 18, 2000
[1]. Further to the Board’s (differently constituted) decision in this matter dated July 25, 2000 the parties met with a Labour Relations Officer. The parties reached agreement on the form of the notice and on a list of entities to be served in this sector dispute in the construction industry.
[2]. The applicant, in accordance with the agreement of the parties, will forward a copy of this decision to those entities listed on the agreed schedule. The following is the agreed notice:

A sector dispute under Section 166 of the Labour Relations Act has been filed with respect to the student residences built at:
(a) Fanshawe College, London, Ontario
(b) University of Western Ontario, London, Ontario
in 1999-2000. The International Union of Painters and Allied Trades, Local 1590 ("the Painters") assert construction of these student residences falls within the industrial, commercial and institutional ("ICI") sector of the construction industry. The general contractor, Bradscot (MCL) Ltd. ("Bradscot"), and the Labourers' International Union of North America, Local 1059 ("the Labourers") assert the construction falls within the residential sector.
If you wish to participate in this proceeding (and you may be required to prove your status to do so), please advise in writing by November 3, 2000, both:

By December 15, 2000, you will be provided with copies of the positions of Bradscot and the Labourers containing their submissions and the material facts upon which they rely. By January 19, 2001 you must file with the Board, Bradscot, the Labourers and the Painters, your formal intervention containing the basis upon which you intervene, all of your submissions and the material facts upon which you rely.
