DECISION OF THE BOARD; April 25, 2000
The applicants had filed an appeal of the failure of an Occupational Health and Safety Inspector to make a decision on May 3, 1999.
Prior to the hearing in this matter the parties entered into the following minutes of settlement:
ONTARIO LABOUR RELATIONS BOARD

Robert Gordon, Nick Tefoglou and Ontario Public Service Employees Union
Applicant,
v.
Ministry of Correctional Services ("MCS")
and
Ministry of Labour
Responding Parties.
The applicant and MCS agree to a full and final settlement of the above-cited matter on the following basis:
- MCS agrees to provide all correctional officers at Whitby Jail during the period of January 1, 2000 and January 1, 2001, with:
a) use of force training (8 hours).
- In addition, MCS agrees to provide the cell extraction teams at Whitby Jail during the period of January 1, 2000 and January 1, 2001 with:
a) cell extraction team basic training (56 hours); and
b) in-house training (80 hours).
The applicant agrees to withdraw all aspects of the proceeding #0662-99-HS.
The parties agree that this settlement will take the form of a consent order of the O.L.R.B.
The parties agree that if either party does not comply with the terms of this settlement, the MCS or the Ontario Public Service Employees Union may file a proceeding under s.96 of the Labour Relations Act, 1995 to enforce those terms.
Except as herein provided, the parties agree that this settlement is entered into on a without precedent or prejudice basis.
