1799-00-ES E. L. Donuts Ltd. o/a Tim Hortons, Applicant v. Ministry of Labour, Responding Party.
Employment Practices Branch File No. 15001820
BEFORE: Harry Freedman, Vice‑Chair.
DECISION OF THE BOARD; November 23, 2000
E. L. Donuts Ltd. o/a Tim Hortons (“E. L.”) forwarded payment of $662.24 in respect of Order to Pay No. 54348 to the Director of Employment Standards together with a form indicating that it was applying for a review of the Order to Pay but that the documents relating to the application for review were not attached.
The Registrar of the Board, by letter dated September 28, 2000, advised E. L. that a proper application for review had to be filed on the correct forms and provided both the correct forms and other requisite information to enable a proper application to be filed. The letter went on to indicate that the proper application had to be filed within 10 working days of that letter and if it was not filed within that time, the application for review may be terminated.
The Board, as of the date of this decision, has not received any further material from E. L. Under these circumstances, there is no proper application before the Board.
Disposition
- Having regard to the time limit set by the Registrar in his letter to E. L. dated September 28, 2000 and E. L.’s failure to file a proper application for review, this proceeding is terminated.
