DECISION OF THE BOARD; December 19, 2000
These matters were scheduled to continue on December 19 and 20, 2000. On the afternoon of December 18, 2000, the Board received a facsimile communication from Mr. Terry Kelly asking that the matters be adjourned as he had had an operation on his wrist on December 15 and did not feel that he could proceed on the 19th. The applicants were prepared to accommodate the responding party’s request and agreed to the adjournment. The hearing dates were therefore adjourned.
However the Vice-Chair has some concerns about the adjournment because Mr. Kelly had requested that two earlier hearing dates in September be adjourned. On that occasion the Board received a message from Mr. Kelly on the morning of the hearing advising that he had had an accident and could not attend. I adjourned the dates but directed Mr. Kelly to provide a written explanation for the need for the adjournment. No such explanation was ever received. The Board then received this request for adjournment the day before the hearing in December. In the circumstances, no further adjournment requests from Mr. Kelly will be granted unless he provides satisfactory proof that he is unable to attend.
These matters are referred to the Registrar to set two further hearing dates.
