This is a referral of a grievance to arbitration filed under section 133 of the Labour Relations Act, 1995, S.O. 1995, c.1 (the “Act”).
The responding party (the “employer”) has filed its request for hearing and Notice of Intent to Defend. However, it does not appear to have served the applicant or any interested parties with those documents. The Board’s Rules of Procedure provide that documents must be delivered to the other parties to the matter.
The responding employer requests that the filing fees paid in respect of another Board file that was withdrawn by the applicant be transferred to this application. The Board declines the request as this is a new application filed under section 133 and payment of the filing fees is required.
