DECISION OF THE BOARD; October 12, 2000
1The Board has reviewed the pleadings and submissions in this matter. The issues raised by the materials, broadly stated, appear to be as follows:
i) whether the meeting of April 19, 1999 was properly called pursuant to ESSA’s By-Laws and Standing Rules;
ii) whether the 2/3 majority required to amend the By-Laws was properly achieved;
iii) whether, by virtue of the By-Laws or otherwise, it is too late for any possible defects in number one or two above to be raised and/or remedied.
2In the event that any party disagrees with the foregoing statement of the issues, they must advise the Board forthwith. Otherwise, the parties will be expected to call whatever evidence is needed to support their positions and argue the case fully in one hearing day. That day will be set expeditiously by the Registrar.
