Decision of the Board
1The applicant purported to file an application under section 68 of the Employment Standards Act, R.S.O. 1990, c. E. 14, as amended (the "Act") for review of Order to Pay No. 48898 with the Board on January 4, 2000. It appears that the applicant paid the amount required by the order to pay to the Director in trust and indicated that it was applying for a hearing. That was all that was filed by the applicant in support of its application.
2The Registrar advised the applicant by letter dated January 6, 2000 that the application had not been made on the proper form and therefore the Board would not process it as it had not been filed in accordance with the Board’s Rules of Procedure. The letter also provided the applicant with a copy of the correct form, the relevant rules and information bulletin. The letter also stated in bold print that the application had to be filed on the correct form with the Board within 20 working days of the date of the Registrar’s letter. Thus, the applicant was directed to file its application on or before Friday, February 4, 2000. No other material was filed with the Board by the applicant as of the date hereof.
3As the application for review was not filed in the form required by the Rules, and as the applicant has not complied with the Registrar’s direction to file the necessary material by the date specified, the application, pursuant to Rule 39 will not be processed any further.
Disposition
4This application is dismissed.
