DECISION OF THE BOARD; January 10, 2000
1This is an appeal under section 61 of the Occupational Health and Safety Act, R. S. O. 1990, c.O-1 as amended (“OHSA”) of an inspector’s order (Board File No. 1247-99-HS) and a request to suspend the operation of the order until the appeal is heard (Board File No. 1248-99-HS).
2The applicant and the affected employee agreed to a resolution of these matters pursuant to the terms set out in a document executed by the parties (including the inspector who issued the order on his own behalf and on behalf of the Ministry of Labor) and filed with the Board dated January 5, 2000. Part of the resolution provides that the applicant requests leave of the Board to withdraw these two proceedings.
3Therefore, having regard to the agreement of the parties and the request of applicant, this appeal and request for suspension are withdrawn.
