Ontario Labour Relations Board
File No.: 1124-00-ES Employment Practices Branch File No.: 43001072
Carlton Howell, a Director, Applicant v. Ministry of Labour, Responding Party.
BEFORE: Harry Freedman, Vice-Chair.
DECISION OF THE BOARD; August 11, 2000
1Carlton Howell advised the Registrar by letter dated July 6, 2000 that he was requesting review of an order designating him as a director. He states in that letter that he was not a director, but rather a shareholder and bookkeeper for the Corporation.
2The letter from Mr. Howell does not identify the Corporation, the date of the Order or who the claimants were. In any event, the Registrar returned the material Mr. Howell filed to him with a letter advising him that the document which purported to be an application for review of an Order to Pay under section 68 of the Employment Standards Act, R.S.O. 1990, c. E. 14, as amended (the "Act") could not be processed. It directed him to file a proper application within 10 working days of the date of the Registrar’s letter and provided him with the correct form, the Board’s Rules and applicable Information Bulletin.
3As of the date of this decision, no further material has been filed by Mr. Howell with the Board. Under these circumstances, the application for review set out in Carter Howell’s letter of July 6, 2000 is hereby dismissed.
