DECISION OF THE BOARD; June 19, 2000
The applicant has referred a grievance concerning the interpretation, application, administration or alleged violation of a collective agreement to the Board for final and binding determination.
Prior to the hearing in this matter, the parties entered into a memorandum of agreement dated June 8, 2000.
Having regard to the Memorandum of Agreement, to the material before it and pursuant to section 133 of the Labour Relations Act, 1995 the Board makes the following declarations and directions:
The Board declares that Rees Mechanical Contractors Ltd. is bound to the collective agreement effective April 30, 2001 between Mechanical Contractors Association Ontario and the Ontario Pipe Trades Council of the United Association of Journeymen and Apprentices of the Plumbing and Pipefitting Industry of the United States and Canada, Local Union 527.
The Board declares that Rees Mechanical Contractors Ltd. has violated the collective agreement mentioned above and in particular the schedules set out in Appendix 7 of the collective agreement and in particular Schedule K.
The Board orders Rees Mechanical Contractors Ltd. to pay to the applicant, as damages, the amount of $14,889.02 on or before 12:00 noon on June 9, 2000, as full and final settlement for the above violations of the collective agreement
