DECISION OF THE BOARD; October 16, 2000
This is a referral of a grievance filed pursuant to section 133 of the Labour Relations Act, 1995 (the “Act”).
Prior to the hearing of this matter the parties entered into a memorandum of agreement.
Pursuant to the memorandum of agreement the Board makes the following declarations and consent orders:
a) that EBCI Framing & Drywall is bound to the collective agreement effective May 1, 1998 to April 30, 2001 as between The Carpenters District Council of Ontario, United Brotherhood of Carpenters and Joiners of America (“C.D.C”) and Carpenters’ Employer Bargaining Agency (“E.B.A.”);
b) that EBCI Framing & Drywall has violated the collective agreement with respect to the Glengate Motel Project, including failure to make the required remittances for July and August, 2000;
c) that EBCI Framing & Drywall pay to the applicant forthwith as damages, the amount of $26,469.51;
d) that EBCI Framing & Drywall provide records of employment for the applicant’s members by no later than October 27, 2000.
