DECISION OF THE BOARD; September 19, 2000
By decision dated September 7, 2000, the Board struck the names of several individual responding parties from the style of cause and directed the parties to make written submissions by September 15, 2000 with respect to an issue identified by the Board in paragraph 8 of its decision (namely whether the Board should exercise its discretion not to hear the complaint if another, more appropriate forum is available to the applicant).
The parties have not filed written submissions on the “forum” issue within the time specified.
By separate letters to the Board dated September 14, 2000, the applicant seeks a reconsideration of the decision to strike certain responding parties from the style of cause and requests an extension of time in which to file written submissions on the forum issue.
The application for reconsideration was not filed in accordance with the Board’s Rules of Procedure and the applicant was so notified by the Registrar on September 18, 2000.
The Board is not prepared to extend the timeline for written submissions on the forum issue solely on the basis of the purported application for reconsideration. However, as no party has made submissions on the forum issue, there is currently insufficient information for the Board to make a determination.
The application is scheduled for a hearing on October 11, 2000 for one day to deal with any and all preliminary issues raised by any party. If further dates are required in respect of this application, they will be set at that time. The hearing will be held in the “Board Room”, 2nd Floor, 505 University Avenue, commencing at 9:30 a.m.
