DECISION OF THE BOARD; December 11, 2000
Decision
The Board has received correspondence from the applicant requesting a copy of the letter from Sandra Christiaens referred to in the Board’s decision of November 24, 2000. A copy of that letter and the accompanying materials are therefore attached to this decision. The applicant also requests that it be provided with particulars of Ms. Christiaens’ allegations. The Board therefore directs that Ms. Christiaens advise the applicant by way of written submissions who advised her that “since a union would most likely be coming in, the company felt this should be the one and had made arrangements with them on our behalf”. She should also advise when the statement was made. If she intends to rely upon any other information or conversations she had with a representative of her employer about this matter she should also include particulars of that conversation. Copies of her submissions should also be provided to the responding party, the Service Employees International Union, Local 220 and the Board.
As Ms. Christiaens was added as an intervenor the Board directs that the application, response and the intervention of the Service Employees International, Union Local 220 be provided to her.
The applicant also requests that the Board direct that the ballots be counted at the meeting with the Labour Relations Officer scheduled for December 20. In the circumstances the Board does not consider it appropriate to direct that the ballots be counted at this time. The applicant may renew its request before the panel hearing the matter on January 2, 2001. The Board also notes that it directed that submissions with respect to the status of the Service Employees International Union Local 220 be filed by December 18 and that that issue would be decided by the panel hearing the matter on January 2, 2001.
