DECISION OF THE BOARD; October 18, 2000
1This is an employer appeal of an Order to Pay made by an Employment Standards Officer.
2A hearing into this matter was scheduled for October 13, 2000 at 9:30 a.m. in Sudbury, Ontario. At the time set for the commencement of the hearing, no one was present on behalf of the applicant. Accordingly, the Board adjourned the hearing, as is its custom, until 10:00 a.m. At 10:00 a.m. no one had appeared for the applicant.
3A review of the file indicated that the applicant was mailed a notice of the hearing. Accordingly, the Board dismissed the application orally.
4This decision confirms that oral decision.
DISPOSITION
5The Board orders that the Director pay out to the individual employees in accordance with the Order to Pay the monies held in trust by the Director. The administration fee therein shall be retained by the Government of Ontario Consolidated Revenue Fund.
