DECISION OF THE BOARD; December 7, 2000
1This is an employer appeal of an Order to Pay issued by an Employment Standards Officer.
2A hearing in this matter was scheduled for 9:30 a.m. on November 17, 2000. At the time set for the commencement of the hearing, the applicants were not present. Accordingly, in accordance with the Board’s normal practice, the Board stood the hearing down until 10:00 a.m. At 10:00 a.m. the Board recommenced and the applicants were still not present.
3At the request of the other parties, the Board dismissed the application in an oral decision since a review of the file suggested that the applicants had notice of the hearing but were not in attendance. This decision confirms that ruling.
DISPOSITION
4This application is dismissed. The Board directs that the wages held in trust and the interest thereon held by the Director be remitted forthwith to the responding party Mary Grace Lorenzo and that the administrative fee be retained by the Government of Ontario Consolidated Revenue Fund.
