DECISION OF THE BOARD; April 28, 2000

This is an application by an employee of a decision of an Employment Standards Officer not to issue an Order to Pay in respect of his termination pay claim. The application is made pursuant to section 67 of the Employment Standards Act, R.S.O. 1990 ch E-14, as amended (the “Act”). The date of the Officer’s letter is January 10, 2000. The time for filing this application expired at 5:00 p.m. on February 24, 2000. It was in fact filed on February 25, 2000 at 8:53 p.m. The Board accepts the applicant’s assertion that this was a miscalculation on his part. The Board extends the time for filing this application to February 25, 2000, pursuant to section 68(4) of the Act.
