Decision
This is an appeal under section 61 of the Occupational Health and Safety Act, R. S.O. 1990, c. O. 1, as am., (the “Act”). The Board, by decision dated September 27, 1999 in Board File No. 1438-99-HS granted the applicant’s request to suspend the operation of the order under appeal pursuant to section 61 (7) of the Act pending the disposition of the appeal in this matter.
Counsel for the applicant, by letter to the Registrar dated February 3, 2000 advised the Board that as a result of discussions among the affected parties, agreement was reached to request that the Board adjourn this appeal sine die pending the applicant’s completion of what the parties referred to as “equivalency study protocols” and the equivalency study it is undertaking.
Rather than adjourn this matter sine die to some indeterminate future date, the Board is of the view that this matter should be adjourned sine die for up to one year before the appeal is terminated. Therefore, the Board hereby adjourns this appeal sine die. Unless a party requests that the Board proceed with the hearing of this appeal within one year from the date of this decision, the appeal will be deemed terminated.
