DECISION OF THE BOARD; October 19, 2000
1The Registrar of the Board advised the applicant, Bridal Factory Ltd., by letter dated September 18, 2000 that the Board would not process the application for review under the Employment Standards Act until it was filed as required by the Rules of Procedure.
2A copy of the Board’s new Rules and the correct application form, Form A-69, was sent to the applicant. The letter of September 18, 2000 advised the applicant that it had 10 working days to file its application and that failure to comply may result in the termination of the application.
3As of the date of this decision the applicant has failed to file an application for review as required by the Rules. In the circumstances the applicant is deemed to have abandoned its appeal for review of Order to Pay No. 55178 in the amount of $926.06 dated August 13, 2000.
DISPOSITION
4This application is terminated. The Director of Employment Standards is directed to pay out the monies pursuant to the Order to Pay No. 55178 to the responding party, Cindy Ramsackal, including any applicable interest accrued while the funds were held in trust.
