Ontario Labour Relations Board
File No.: 1932-00-U Parties: Russel Bélanger, Applicant v. CUPE 1974, Responding Party. Before: Laura Trachuk, Vice-Chair. Decision of the Board: November 28, 2000
1. Pursuant to the Board’s decision of November 1, 2000, submissions have now been received from the applicant. After reviewing those submissions and the application the Board considers it appropriate to set this matter down for a consultation.
2. The responding party asks that the Board not inquire further into the application since it referred the applicant’s workers compensation claim to a representative of the CUPE national office and only the local is named in the application. The applicant does assert that he went to the local for assistance and it advised him he had compensation problem and referred him to a national representative. The applicant also alleges that he has been ill served by that individual. However, a review of the application and submissions discloses that the foundation of the complaint is the alleged lack of assistance by the applicant’s union with his efforts to be reinstated to a job that will accommodate his disability. In these circumstances the Board does not consider it appropriate to dismiss the matter without a consultation.
3. The application will be referred to the Labour Relations Officer.
