DECISION OF THE BOARD; February 11, 2000
The applicant has referred a grievance concerning the interpretation, application, administration or alleged violation of a collective agreement to the Board for final and binding determination.
Prior to the hearing in this matter, the parties entered into Minutes of Settlement dated February 10, 2000.
Having regard to the Minutes of Settlement, to the material before it, and pursuant to section 133 of the Labour Relations Act, 1995 (the “Act”) , the Board makes the following declarations and directions:
(1) The Board declares that Marin Contracting Limited is bound to the Carpenters Provincial Collective Agreement between the Carpenters Employer Bargaining Agency and the Carpenters District Council effective May 1, 1998 to April 30, 2001 (“Carpenters Provincial Collective Agreement”).
(2) The Board declares that Marin Contracting Limited has inadvertently violated the Carpenters Provincial Collective Agreement by failing to pay the appropriate wage rates.
(3) The Board orders Marin Contracting Limited to pay $7,743.29 to the union, as damages within the next three business days, damages to be held in trust for Greg Weickowski, Luca Sipic and Josip Grzetic.
(4) The Board orders that Marin Contracting Limited shall also pay $1,450.00 in costs to the union pursuant to Article 9:18 of the Carpenters Provincial Collective Agreement:
