Decision
1This application was scheduled for hearing before this panel of the Board on December 21, 2000. Unfortunately, as a result of certain documents having been inadvertently provided to this panel of the Board in preparation for the hearing without the knowledge of the Registrar, the Labour Relations Officer who had been engaging in settlement efforts or any of the parties to this proceeding, the parties agreed with the Board’s concern that the hearing of this matter could not proceed further before the Board as presently constituted. The Board, through the Officer, advised the parties of the documents that had been placed in the Board’s file and had been brought to our attention the day before the hearing. Upon receiving that information and being advised of our concerns, the parties agreed that the hearing be adjourned to dates to be fixed by the Registrar in consultation with the parties.
2The Board convened the hearing of this matter and apologized to the parties for the unfortunate circumstances that required that this matter be adjourned. The Labour Relations Officer and the panel then removed from the file and destroyed all copies of the documents that had given rise to the Board’s concerns. Fortunately, the parties were able to agree upon a number of dates for the commencement of the hearing of this matter before a different panel of the Board, and the Registrar was in a position to fix those hearing dates with the parties’ agreement.
3Therefore, this matter is referred to the Registrar to be listed for hearing before a panel of the Board that does not include any members of this panel of the Board.
4The Registrar has fixed March 9, 15 and 16, 2001 as the new hearing dates for this matter. The hearing will take place at the Board Room, 505 University Ave., 2nd Floor, commencing at 9:30 a.m. local time on those dates.
