DECISION OF THE BOARD; September 26, 2000
By a decision dated August 4, 2000 the Board upheld the Employment Standards Officer’s finding that Ms. Fox was an employee and that the employer was therefore liable to pay her vacation pay and public holiday pay. However, since the employer had disagreed with the quantum of the Order to Pay, the Board requested that the employer make its submissions regarding what it believed Ms. Fox should be entitled to. The Board imposed deadlines for the filing of submissions. To date nothing has been received by the Board, although the time for filing submissions has long since passed.
In the circumstances, it would appear that John A. Ford & Associates Inc. has decided not to contest the amount of the Order to Pay.
DISPOSITION
- The Board therefore finds that the amount of the Order to Pay is correct. The Board requests that the Director of Employment Standards remit to Susan Fox the amount of $2,726.10 for vacation pay and public holiday pay owing, along with any accrued interest.
