Decision of the Board
1Pursuant to the Board’s direction of June 29, 2000, a representation vote was taken on July 4, 2000.
2The Board has received representations dated July 4, 2000 from the applicant, in which he claims that the vote was flawed as a result of confusion and misunderstanding surrounding the ballot and the nature of the vote. The applicant also enclosed letters dated July 4, 2000 from three employees in support of his position that employees in the bargaining unit misunderstood the nature of the vote. The Board subsequently received a letter from counsel for the applicant dated July 10, 2000 requesting leave to withdraw this application.
3The Board notes that the issues raised by the applicant and three other employees as set out in the applicant’s correspondence dated July 4, 2000 will be addressed in Board File No. 1097-00-R.
4For these reasons, the Board will issue a final decision in this matter without a hearing.
5On the taking of the representation vote directed by the Board, not more than fifty per cent of the ballots cast by employees in the bargaining unit were cast in opposition to the responding party.
6The application is therefore dismissed.
7The Registrar will destroy the ballots cast in the representation vote taken in this matter following the expiration of 30 days from the date of this decision unless a statement requesting that the ballots should not be destroyed is received by the Board from one of the parties before the expiration of such 30-day period.
8Meeting and hearing dates set previously are hereby cancelled.
9The employer is directed to post copies of this decision immediately, adjacent to all copies of the "Notice of Vote and of Hearing" posted previously. These copies must remain posted until the date that had been set for the hearing.
